Terms of Service

These terms are an agreement between you and Diexar ("we", "us"), the operator of ListGuard at listguard.cloud("the service"). By creating an account or using the service, you agree to these terms. If you do not agree, please do not use ListGuard.

2. Eligibility
You must be at least 18 years old and able to enter into a binding agreement. If you use ListGuard on behalf of a company or other organisation, you confirm you are authorised to accept these terms on its behalf.
3. What ListGuard does
ListGuard helps you clean and check email lists: it can remove duplicates, invalid or disposable addresses, role addresses and dead domains, check formatting and domain health, scan content for spam signals, and, if you connect your own key, run third-party mailbox verification. It gives you a cleaned list and a report of what was removed and why. No list-cleaning tool is perfect, so treat the results as guidance rather than a guarantee that every judgement is right.
4. Your account
- Provide accurate information when you register.
- Keep your password confidential; you are responsible for activity under your account.
- Tell us promptly if you believe your account has been accessed without your permission.
5. Your lists and your responsibilities
You keep ownership of the lists and data you upload. You are responsible for making sure you have the legal right to process the contacts in those lists, including a valid legal basis to email them. You agree to use ListGuard only with data you are allowed to process, and only for lawful email practices.
ListGuard does not send email. It cleans and checks lists. A cleaned list improves your chances of good deliverability, but sending responsible, permission-based email remains your responsibility.
6. Acceptable and fair use
You agree not to:
- use ListGuard for lists you have no lawful right to process, or to support spam or unlawful email;
- attempt to break, overload, reverse-engineer or gain unauthorised access to the service;
- work around plan limits, resell the service, or abuse the free plan through multiple accounts;
- upload malicious files or content that infringes someone else's rights.
We may suspend or limit accounts that breach this section to protect the service and other users.
7. Plans, pricing and payment
ListGuard offers a Free plan and a paid Pro plan. Prices are shown in US dollars (USD). The Free plan is available at no cost within its usage limits. Pro is offered at $9 per month and unlocks higher limits, as described on our pricing page.
Paid checkout is being finalised and is not yet active. When it goes live, the payment terms shown at checkout (billing cycle, renewal, applicable taxes and the payment provider used) will apply in addition to these terms. Plan limits and prices may change; we will give reasonable notice of changes that affect a paid plan you are on.
8. Cancellation and refunds
ListGuard Pro is billed monthly and you can cancel at any time. Cancellation stops the next payment and takes effect at the end of your current billing month; you keep Pro access until then.
Refunds are simple: because ListGuard is a digital service you can use straight away, once you have used the paid service it counts as delivered and is no longer refundable. If you are a consumer in the EU and have not yet used the paid service, your statutory right of withdrawal still applies.
9. Third-party integrations
If you connect a ZeroBounce or Hunter.io API key, your use of those services is governed by their own terms and pricing, and you are responsible for your account and usage with them. We are not responsible for the availability, accuracy or charges of third-party services.
10. Intellectual property
The ListGuard software, design and brand belong to us. These terms do not give you any right to our software or brand beyond using the service as intended. Your data and your cleaned lists remain yours.
11. Disclaimers
The service is provided "as is" and "as available". We do not guarantee that cleaning your list will produce any particular deliverability, open or bounce rate, that every address judgement is correct, or that the service will be uninterrupted or error-free. You remain responsible for reviewing your results before you use them.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, lost revenue, or loss of data arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim. Nothing in these terms excludes liability that cannot lawfully be excluded, and your mandatory statutory rights as a consumer are not affected.
13. Suspension and termination
You may close your account at any time. We may suspend or end your access if you breach these terms, if required by law, or if needed to protect the service or other users. On termination, your right to use the service stops; account deletion is handled as described in our Privacy Policy.
14. Changes to the service and these terms
We may improve, change or discontinue parts of the service, and we may update these terms as it evolves. When we make a material change to these terms, we will update the date at the top of this page. Continuing to use ListGuard after a change means you accept the updated terms.
15. Governing law and jurisdiction
These terms are governed by the laws of Spain. Any dispute will be subject to the competent courts of Alicante, Spain, unless mandatory consumer-protection law entitles you to bring proceedings in the courts of your own country of residence.
